These Terms & Conditions ("Terms") govern your access to, and use of the website, mobile application, online ordering platform, and loyalty program operated by Houston TX Hot Chicken (referred to as "we," "our," or "us").

Our online ordering and loyalty program is powered by Thanx.

By accessing or using our website, app, or loyalty program, you agree to these Terms.

1. Eligibility

To use our online ordering system or loyalty program, you must:

  • Be at least 18 years old
  • Have the legal authority to enter into binding agreements
  • Not be prohibited from using such services under applicable law

If you do not meet these requirements, you may not use the service.

2. Loyalty Program & Rewards

Our loyalty program is powered by Thanx and allows customers to earn rewards and promotions through qualifying purchases.

Through the program you may receive:

  • Loyalty rewards
  • Special promotions
  • Discounts
  • Exclusive offers
  • Customer experiences

These offers are collectively referred to as "Rewards" or "Opportunities."

Rewards are:

  • Not redeemable for cash
  • Not transferable
  • Subject to expiration
  • Subject to change at any time

Houston TX Hot Chicken reserves the right to modify or discontinue the loyalty program at any time.

3. Creating an Account

To access certain features, you may be required to create an account.

When creating an account you agree to:

  • Provide accurate and complete information
  • Maintain the security of your login credentials
  • Be responsible for activity that occurs under your account

You may only create one account, and accounts are non-transferable.

If you believe your account has been compromised, you must notify us immediately.

4. Linking Payment Cards

The loyalty system allows you to link a credit or debit card to automatically track eligible purchases.

By linking a payment card, you agree that:

  • Payment networks (such as Visa or Mastercard) may review transactions
  • Transaction data may be shared with Thanx for the purpose of tracking qualifying purchases and rewards progress

Not all cards are eligible, including:

  • Corporate cards
  • HSA or FSA cards
  • Government prepaid cards (including EBT)
  • Certain prepaid cards or cards not processed through major payment networks

Transactions that may not qualify include:

  • PIN-based purchases
  • Some third-party digital wallet payments
  • Transactions not processed through payment network systems

It may take up to 7 days for eligible purchases to appear in your rewards progress.

5. Qualifying Purchases & Rewards Progress

Eligible purchases made at participating Houston TX Hot Chicken locations may count toward earning rewards.

These purchases are referred to as "Qualifying Purchases."

Qualifying Purchases contribute to your Reward Progress, which may unlock rewards once specific thresholds are reached.

Please note:

  • Returned purchases may reverse reward progress
  • Fraudulent activity may result in account termination
  • Rewards must be redeemed according to the terms provided

6. Online Ordering

Our online ordering system allows customers to place orders through our website or mobile app.

By placing an order, you agree that:

  • All information provided is accurate
  • Payment information is valid
  • Orders are subject to availability

We reserve the right to:

  • Cancel or refuse orders
  • Modify menu items
  • Adjust pricing without notice

If an item becomes unavailable after ordering, we may:

  • Offer a substitute item
  • Provide a refund for the unavailable item

7. Exclusive Deals & Promotions

From time to time, we may offer exclusive deals or promotions through the loyalty platform.

These offers may include:

  • Limited-time discounts
  • Special menu bundles
  • Digital redemption codes
  • Promotional rewards

These offers:

  • May be subject to additional terms
  • May be limited in quantity or time
  • May be cancelled or modified at any time

Houston TX Hot Chicken is responsible for fulfilling the food and services offered, while Thanx is responsible for the technology platform facilitating the promotion.

8. Disputes Regarding Purchases or Rewards

If you experience an issue regarding:

  • A purchase
  • A reward
  • Reward progress
  • A promotion

You must contact Houston TX Hot Chicken directly.

Thanx and its technology providers are not responsible for disputes between customers and merchants regarding purchases or reward redemption. Thanx and its technology providers are only responsible for the technology platform facilitating the loyalty program.

9. Prohibited Activities

You agree not to use the website, app, or loyalty program to:

  • Provide false or fraudulent information
  • Attempt to access other users' personal information
  • Interfere with the system or servers
  • Use automated tools to scrape or extract data
  • Resell or transfer rewards
  • Attempt to redeem rewards multiple times

Violations may result in account suspension or termination.

10. Account Suspension or Termination

You may cancel your account at any time.

If your account is cancelled:

  • All accumulated rewards and progress may be lost
  • You may lose access to the loyalty program

We may suspend or terminate accounts if:

  • These Terms are violated
  • Fraudulent activity is suspected
  • Required by law

Accounts inactive for twelve (12) months or longer may be automatically cancelled, provided that we will send email notice to the address on file at least thirty (30) days prior to cancellation of any account with accrued Rewards.

11. Intellectual Property

All content on the website and app, including:

  • Logos
  • Images
  • Menu descriptions
  • Branding

is the property of Houston TX Hot Chicken and may not be copied or used without permission.

12. Disclaimer of Warranties

The website, mobile app, and loyalty services are provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that the services will be uninterrupted or error-free.

13. Limitation of Liability

To the maximum extent permitted by law:

Neither Houston TX Hot Chicken, Thanx, nor their service providers will be liable for any indirect, incidental, or consequential damage arising from the use or inability to use the service.

Total liability shall not exceed the greater of (i) one hundred dollars ($100) or (ii) the total amounts paid by you to Houston TX Hot Chicken in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions may not allow certain liability limitations.

The foregoing limitations do not apply to: (a) liability arising from our gross negligence, willful misconduct, or fraud; (b) liability for death or bodily injury caused by our negligence; (c) our indemnification obligations; (d) infringement of a party's intellectual property rights; or (e) any liability that cannot be limited or excluded under applicable law.

14. Force Majeure

We are not responsible for service interruptions caused by events beyond our control, including:

  • Natural disasters
  • Internet outages
  • Power failures
  • Government orders
  • Pandemics
  • Labor disruptions

15. Governing Law

These Terms are governed by the laws of the State of Nevada, excluding conflict-of-law rules.

Any disputes will be resolved in the courts located in Clark County, Nevada.

Notwithstanding the foregoing, nothing in these Terms waives, limits, or restricts any non-waivable right or remedy available to you under the consumer protection laws of the state in which you reside, including (without limitation) the Texas Deceptive Trade Practices-Consumer Protection Act, the California Consumers Legal Remedies Act, or similar statutes. If any provision of these Terms is held unenforceable under the law of your state of residence, such provision shall be modified only to the extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.

16. Arbitration; Class Action Waiver; SMS Consent

16.1 Binding Arbitration

PLEASE READ CAREFULLY. Except for claims for injunctive relief to protect intellectual property rights and claims brought in small claims court, you and Houston TX Hot Chicken agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, the loyalty program, or your use of any of the foregoing (each, a "Dispute") shall be resolved exclusively through final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect. The arbitration shall be conducted in Clark County, Nevada, or by video conference at your election. The arbitrator's award shall be final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration provision.

16.2 Class Action Waiver

YOU AND HOUSTON TX HOT CHICKEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

16.3 30-Day Right to Opt-Out

You may opt out of this arbitration agreement by sending written notice of your decision to opt out to the contact address set forth in Section 18 within thirty (30) days after first accepting these Terms. Your notice must include your name, mailing address, email address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

16.4 SMS/Text Message Consent

By providing your mobile number and opting in to receive text messages from us, you expressly consent to receiving recurring marketing and promotional text messages from Houston TX Hot Chicken and our service provider Thanx at the number you provide, including messages sent using an automatic telephone dialing system or prerecorded voice. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. Text HELP for help or STOP to opt out at any time. For our SMS terms and privacy practices, see our Privacy Policy. This consent is separate from your acceptance of these Terms and may be withdrawn at any time by replying STOP to any message. For California, Florida, Maryland, Oklahoma, and Washington residents, additional state-specific notices may apply and are provided at the point of opt-in.

17. Changes to These Terms

We may update these Terms periodically.

If significant changes occur, we will attempt to provide notice at least 30 days before the updated terms take effect.

Continued use of the services after updates means you accept the revised Terms.
